These Terms and Conditions (the “Terms”) govern the use of the Night Eye browser extension, the Night Eye website at https://nighteye.app, the billing portal at https://billing.nighteye.app, Night Eye accounts, support services and related functionality (together, “Night Eye”).
Please read these Terms before using Night Eye. They form a contract between you and PROMOTINO OOD. If you are a consumer, nothing in these Terms excludes or limits rights that cannot lawfully be excluded or limited under the law applicable to you.

In these Terms, “Promotino,” “we,” “us” and “our” mean PROMOTINO OOD.
2. Scope and acceptance
2.1 Acceptance inside the extension
You accept these Terms by actively selecting the Terms acceptance checkbox presented inside the Night Eye extension. The checkbox must not be preselected. We may keep a record of the acceptance, including the applicable Terms version, date, time and associated account or installation identifier.
Your acceptance covers Night Eye Lite and the general rules applicable to any paid plan that you may later purchase. A paid contract is completed only when you select a paid plan and confirm an order that clearly indicates an obligation to pay.
2.2 Information shown at purchase
Before you place a paid order, we will show the essential information for that purchase, including the selected plan, its main features, the total price and applicable taxes, the billing period, whether it renews automatically, how to cancel and when access begins. The information shown at checkout and in the order confirmation forms part of your contract with us.
2.3 Changes requiring renewed acceptance
If we make a material change to these Terms that requires renewed consent under applicable law or materially changes your contractual obligations, we may ask you to accept the updated Terms again. Section 22 explains how changes to these Terms are handled.
2.4 Age and authority
You must have the legal capacity required in your country to enter into these Terms. If you do not have that capacity, you may use Night Eye only with the consent and supervision of a parent or legal guardian. A person purchasing a paid plan for a minor must be legally authorised to do so.
If you use Night Eye for an organisation, you confirm that you are authorised to accept these Terms on its behalf. Consumer-specific provisions apply only to persons acting mainly outside their trade, business, craft or profession.
3. Night Eye plans
3.1 Lite
Lite is the free version available after the extension is downloaded and these Terms are accepted. Its current features and usage limits are described in the extension, the applicable browser-store listing or the Night Eye website.
3.2 Pro and Pro Max
Pro and Pro Max are paid plans supplied as annual subscriptions. Unless cancelled before the renewal charge, each subscription automatically renews for another one-year period under Section 9.
3.3 Ultimate
Ultimate is purchased with a one-time payment and does not renew automatically. Its features, usage limits and licence duration are those clearly displayed at checkout and confirmed after purchase.
3.4 Plan descriptions and promotions
The exact features, supported browsers, usage limits and price of a plan are those displayed when you select or purchase it. If a specific checkout or order-confirmation term conflicts with a general product description, the checkout and order confirmation control for that transaction, unless mandatory law provides otherwise.
Any trial, discount or promotion is governed by the specific conditions disclosed before it is accepted. We will not convert a free offer into a paid recurring subscription unless the recurring price and terms are clearly disclosed and the user provides the legally required consent.
4. Licence to use Night Eye
Subject to these Terms and the limits of your plan, Promotino grants you a limited, non-exclusive, non-transferable and non-sublicensable licence to install and use Night Eye for your own personal or internal business purposes.
Night Eye is licensed, not sold. Promotino and its licensors retain all rights, title and interest in Night Eye, including its software, design, algorithms, branding, documentation and other intellectual property, except for the limited licence expressly granted to you.
The licence applies only for the duration and within the usage limits of the applicable plan. You must not share or transfer a paid licence or account beyond the number of users, accounts, devices or browsers permitted by that plan.
5. Functionality and third-party dependencies
5.1 What Night Eye does
Night Eye changes or processes website colours and other visual elements that the extension can technically access. Results can vary because websites use different technologies, structures, security settings and visual elements.
5.2 Websites and browsers outside our control
Night Eye depends on third-party websites, browsers, browser stores, operating systems and security mechanisms that Promotino does not control. Changes made by those third parties may affect Night Eye or prevent particular elements or webpages from being processed.
Promotino does not guarantee that Night Eye will work correctly on every webpage, that every visual element can be changed, or that every website-specific issue can or will be resolved. We are not required to resolve problems caused by third-party websites, browsers, browser stores, operating systems, security restrictions or other circumstances outside our reasonable control.
This Section does not exclude or limit mandatory consumer rights where Night Eye fails to provide the paid core functionality described for a supported browser.
5.3 Supported environments
Supported browsers and relevant technical or compatibility requirements are identified on the Night Eye website, in the extension or in the applicable browser-store listing. You are responsible for using a supported browser and operating-system version and for installing reasonably required Night Eye, browser and security updates.
6. Accounts and security
You must provide accurate information when creating an account or purchasing a plan and keep it reasonably up to date. You are responsible for maintaining the confidentiality of your login credentials and for activity performed through your account, except where that activity results from a security failure attributable to Promotino.
You must notify us promptly at [email protected] or through the private support chat if you believe that your account or licence has been accessed without authorisation.
You must not sell, rent, transfer or share an account or licence in a way that exceeds your plan limits. We may use proportionate technical measures to prevent fraud, unauthorised licence sharing and circumvention of plan restrictions.
7. Acceptable use
You must not:
- use Night Eye unlawfully, fraudulently or in a manner that infringes another person’s rights;
- distribute, rent, lease, sublicense, resell or commercially exploit Night Eye except with our written permission;
- copy, modify, create derivative works from, reverse engineer, decompile or disassemble Night Eye, except to the limited extent that applicable law expressly permits this despite a contractual restriction;
- bypass licence, subscription, security or usage controls;
- use Night Eye to introduce malicious code, interfere with systems, obtain unauthorised access or compromise another person’s security or privacy;
- remove or alter proprietary notices; or
- misuse the support service, including by sending unlawful, threatening or knowingly harmful material.
8. Purchases, payments and activation
8.1 Direct purchases
For purchases made through https://billing.nighteye.app, Promotino is the trader and contracting seller. Stripe processes the payment on our behalf. Stripe’s processing terms may apply to the payment method, but they do not replace these Terms or reduce your mandatory rights against Promotino.
8.2 Apple App Store purchases
Purchases made through Apple’s App Store are also subject to the applicable Apple billing and platform rules. Apple processes those payments and may administer subscription management, cancellation and refund requests through the user’s Apple account. These Terms continue to govern your use of Night Eye, and applicable Apple rules do not reduce any mandatory rights you have under applicable law.
8.3 Prices and taxes
The total price, billing currency and any applicable taxes will be displayed before you place the order. You authorise the displayed amount to be charged using your selected payment method when you activate the payment button.
8.4 Immediate activation
Paid access is normally activated immediately after the payment processor confirms successful payment. If activation is delayed, contact us through the support chat or at [email protected].
8.5 Purchase confirmation
After a direct purchase, we will provide an electronic confirmation capable of being retained by you. It will identify the plan, price, purchase date, access or renewal information, cancellation method, the applicable Terms and, where relevant, your request for immediate supply and acknowledgement concerning the right of withdrawal.
8.6 Payment failure and chargebacks
If a payment fails, is reversed or is subject to a chargeback, we may suspend the corresponding paid access while the matter is investigated or until the amount lawfully due is paid. We will not treat a good-faith request to exercise statutory consumer rights as misuse. If you believe a charge is incorrect, please contact us so that we can investigate it.
9. Annual subscriptions, renewal and cancellation
9.1 Automatic renewal
Pro and Pro Max are annual subscriptions. When you purchase one of these plans, the checkout will clearly state that it will automatically renew for successive one-year periods unless cancelled before the next renewal charge. We will obtain affirmative consent to the automatic-renewal terms before charging you and retain evidence of that consent for the period required by applicable law.
9.2 Renewal reminders
For direct Pro and Pro Max subscriptions, Promotino will send an electronic reminder between 15 and 45 days before each annual renewal. The reminder will identify the plan, the renewal date, the renewal period, the amount to be charged and an accessible online cancellation method. For an Apple subscription, Apple may provide renewal notices and subscription controls under its platform rules.
9.3 Price changes
If the renewal price of a direct subscription will change, we will give you a clear electronic notice at least 15 days and no more than 30 days before the new price takes effect, unless applicable law requires a different notice period. The notice will state the new price and explain how to cancel. A changed subscription price will not be charged before the next renewal.
9.4 Cancelling renewal
You may cancel automatic renewal at any time before the renewal charge is processed. You do not need to cancel one day or more in advance. Cancellation stops future renewal charges but does not normally end access already paid for; your paid access continues until the end of the current annual period.
Direct subscriptions can be cancelled online through the account and billing portal at https://billing.nighteye.app/client/sign-in. Apple subscriptions must normally be cancelled through the subscription settings of the relevant Apple account. You may also contact our support team for assistance.
9.5 Effect of cancellation
When a Pro or Pro Max subscription ends, the account may revert to the features and limits of Lite. Cancellation alone does not create a right to a full or partial refund for the remaining paid period, except where a refund or other remedy is required by applicable law or expressly offered by us.
Ultimate is not an automatically renewing plan and does not require subscription cancellation.
10. EU right of withdrawal and refund policy
10.1 Fourteen-day withdrawal period
If you are a consumer in the European Union, you generally have the right to withdraw from a distance contract within 14 days from the day the contract is concluded, without giving a reason, unless a statutory exception applies. Consumers in other countries receive any equivalent mandatory cancellation rights provided by the law applicable to them.
10.2 Immediate supply of digital content
Because paid Night Eye access is activated immediately, we will ask an EU consumer purchasing directly from us to provide prior express consent to immediate supply and to acknowledge that the statutory right of withdrawal will be lost once supply of the digital content begins. This request will be separate from the general acceptance of these Terms and will not be preselected.
Where all applicable statutory conditions have been satisfied and paid access has been activated at your request, the 14-day change-of-mind right of withdrawal may no longer be available. If the legally required consent, acknowledgement or confirmation was not properly obtained, your right is not lost merely because these Terms contain this Section.
If applicable law classifies any part of Night Eye as a service rather than digital content, the corresponding mandatory withdrawal rules for services apply.
10.3 How to exercise a withdrawal right
Where a right of withdrawal remains available, you may exercise it by sending a clear statement before the deadline to [email protected], by using the private support chat, or by using the model form at the end of these Terms. You do not have to use the model form.
For an Apple purchase, you may also need to submit the request through Apple’s applicable purchase or refund process. Contact us if you are unsure where to submit it. This does not reduce any mandatory right.
Where withdrawal is valid, we will reimburse amounts due within the period and by the method required by applicable law, normally using the original payment method unless otherwise agreed.
10.4 Refunds outside mandatory rights
We do not offer discretionary change-of-mind refunds after paid digital access has been activated and the applicable withdrawal right has been validly lost or has expired. This policy does not exclude refunds, price reductions, corrections of unauthorised or incorrect charges, remedies for non-conformity, or other rights required by applicable law.
11. Conformity and mandatory consumer remedies
Consumers have statutory rights when digital content or a digital service is not supplied, is not as described, or does not meet mandatory requirements of conformity. These rights are separate from the right of withdrawal and cannot be excluded by disclaimers in these Terms.
If paid Night Eye functionality does not conform to the contract, you may ask us to bring it into conformity. Where required by law, this will be done free of charge, within a reasonable time and without significant inconvenience. Depending on the circumstances and applicable law, you may also be entitled to a proportionate price reduction or to terminate the affected paid contract and receive the reimbursement required by law, including where conformity is impossible, is refused, is not achieved within the required time, or the lack of conformity is sufficiently serious.
We will provide updates, including security updates, to the extent required by applicable law and the nature and duration of the contract. A consumer may be responsible for a problem caused solely by failure to install an update supplied with adequate installation instructions where the legal conditions for that responsibility are met.
To report a conformity problem, contact us through the private support chat or at [email protected] and identify the account, supported browser and affected functionality. Screenshots may be helpful, but you should remove passwords, payment details and unrelated personal information before sending them.
The limitations concerning third-party websites and browsers in Section 5 remain relevant when determining whether Night Eye itself is non-conforming, but they do not override mandatory remedies where the promised paid core functionality fails on a supported browser.
12. Support and user submissions
Support is available through the private chat in Night Eye and by email at [email protected]. We do not promise that every request or website-specific issue can be resolved.
The support chat allows users to submit messages and images. Support messages and images are not published and are accessible only to authorised support personnel and, where technically necessary, service providers acting under our instructions. They are handled in accordance with our Privacy and Cookie Policy.
You confirm that you have the right to submit any content you send to support. Do not send passwords, full payment-card details, authentication codes, health information or other sensitive or unnecessary personal data.
You grant Promotino a limited, non-exclusive licence to host, copy and use submitted support content only as reasonably necessary to provide support, troubleshoot Night Eye, improve relevant functionality, protect the service or comply with law. This licence ends when the content is no longer needed for those purposes, subject to lawful retention requirements and our Privacy and Cookie Policy. Support content will not be used in public marketing without separate permission.
13. Changes to Night Eye
Night Eye depends on third-party browsers, browser stores, operating systems and websites. We may modify, replace, suspend or discontinue functionality where reasonably necessary because of changes to those third-party technologies, technical limitations, security requirements, legal obligations, browser-store policies, maintenance or product development.
Changes will not result in an additional charge during an already paid period unless you expressly agree or the charge is required by law. Where a change negatively affects a consumer’s access to or use of continuously supplied paid functionality beyond a minor extent, we will provide advance notice on a durable medium where required by law, explain the effect and inform the consumer of any right to terminate without charge within the applicable statutory period.
Urgent security, legal or third-party compatibility changes may be implemented without advance notice where advance notice is not reasonably possible. We will provide information afterward where required.
Promotino does not guarantee that functionality affected by circumstances outside its reasonable control will remain available or operate in the same way. This Section does not exclude any notice, termination, price-reduction, reimbursement or other right that cannot be excluded under applicable law.
14. Suspension and termination
14.1 When we may act
We may proportionately restrict, suspend or terminate access where reasonably necessary because of:
- fraud, an unlawful use or a material security risk;
- unauthorised licence sharing or circumvention of plan or security controls;
- a payment failure, reversal or chargeback relating to the affected paid access;
- a material or repeated breach of these Terms; or
- a binding legal requirement or browser-store/platform requirement.
14.2 Notice and opportunity to correct
For an ordinary remediable breach, we will normally explain the issue and allow at least seven days to correct it before suspending or terminating access. We may act immediately where the breach is serious, fraudulent or unlawful, creates a security or privacy risk, threatens Night Eye or third parties, or where immediate action is legally or technically required.
Where permitted, we will explain the reason for the action and how you may contact us to challenge a mistake. We will not use this Section to penalise a consumer for making a good-faith complaint, requesting a charge correction or exercising a statutory right.
14.3 Consequences
If we terminate paid access without fault by the user, we will provide any reimbursement or remedy required by applicable law. If access is terminated for a serious breach attributable to the user, we do not provide a voluntary refund, without prejudice to any mandatory right.
You may stop using Lite at any time. You may end future Pro or Pro Max renewal under Section 9. Termination or expiry does not affect provisions that by their nature continue to apply, including provisions concerning intellectual property, accrued payment obligations, liability, disputes and general contractual rules.
15. Intellectual property
Night Eye and its original content, software, visual design, names, logos and documentation are owned by or licensed to Promotino and are protected by applicable intellectual-property laws. No right is granted except the limited licence in Section 4.
Third-party names, websites, browsers, platforms and trademarks belong to their respective owners. References to them do not imply sponsorship or endorsement unless expressly stated.
16. Intellectual-property complaints
If you believe that material made available by Promotino infringes your copyright, trademark or another intellectual-property right, send a notice to [email protected] containing:
- your name and contact details;
- identification of the protected work or right;
- identification and location of the material concerned;
- an explanation of the claimed infringement;
- a statement that the information supplied is accurate and that you are the rightsholder or authorised to act for the rightsholder; and
- any supporting evidence reasonably necessary to assess the complaint.
We may request further information and will review the complaint under applicable Bulgarian and EU law and any other law that validly applies.
17. Privacy and cookies
Our processing of personal data in connection with Night Eye is described in the Night Eye Privacy and Cookie Policy at https://nighteye.app/privacy-policy/.
Acceptance of these Terms is not consent to optional cookies, advertising technologies or analytics. Where consent is required, it will be requested separately through an appropriate cookie or privacy control. Refusing optional processing will not prevent access to functionality that does not require it.
18. Availability and disclaimers
We use reasonable care in providing Night Eye, but websites, browsers, browser stores, operating systems, internet connections and security systems can change or become unavailable without our control. We do not promise uninterrupted or error-free availability, compatibility with every website or device, or that every website-specific visual result will meet each user’s preference.
To the fullest extent permitted by law, Night Eye is provided without voluntary warranties beyond those expressly stated in these Terms or in the relevant plan description. Nothing in this Section excludes statutory conformity obligations, mandatory consumer guarantees or any other right that cannot lawfully be excluded.
Night Eye is a visual-display tool and is not medical advice or a medical device. You remain responsible for choosing display settings appropriate for your comfort and circumstances.
19. Limitation of liability
19.1 Matters that are never excluded
Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by law. This includes, where applicable, liability for fraud or intentional misconduct; death or personal injury caused by negligence; gross negligence where it cannot be limited; mandatory consumer remedies; and liability under data-protection or other laws to the extent it cannot lawfully be limited.
19.2 Excluded losses where legally permitted
To the fullest extent permitted by law, Promotino is not liable for indirect, incidental, special, exemplary, punitive or consequential loss, or for loss of profit, revenue, business opportunity, goodwill or data, where such loss was not a reasonably foreseeable result of our breach. This exclusion does not apply where it would restrict a mandatory consumer right or would otherwise be unfair or unlawful.
19.3 Liability cap
Where a monetary cap is legally permitted, Promotino’s total aggregate liability arising from or relating to a paid plan is limited as follows:
- for Pro or Pro Max, the total amount actually paid to Promotino for the affected plan during the 12 months immediately preceding the event giving rise to the claim; and
- for Ultimate, the one-time purchase price actually paid for the affected licence.
For Lite, Promotino’s liability is limited to the extent permitted by law, but no monetary cap in these Terms overrides liability or remedies that cannot lawfully be limited.
The exclusions and caps in this Section apply only to the extent valid under the law applicable to the claim.
20. Complaints and dispute resolution
Please submit complaints first through the private support chat or by email to [email protected]. Include the email address connected to the account, the relevant transaction or plan, and a concise description of the requested resolution. Do not include passwords or full payment-card details.
We will review complaints in good faith and provide the information about alternative dispute resolution required by applicable law. A consumer may also contact the Bulgarian Commission for Consumer Protection (KZP) and may request assistance from a competent conciliation commission. Information is available at https://kzp.bg/bg/pomiritelna-komisiya. Participation in a particular alternative dispute-resolution procedure is subject to applicable legal requirements and, where participation is voluntary, Promotino’s express agreement. After an unresolved complaint, we will tell the consumer whether we are obliged or willing to use the relevant procedure where applicable law requires that information.
Use of an out-of-court process does not remove a consumer’s right to bring a claim before a competent court.
21. Governing law and courts
These Terms and your relationship with Promotino are governed by Bulgarian law.
If you are a consumer, this choice of law does not deprive you of mandatory protections provided by the law of the country in which you habitually reside where those protections apply regardless of the chosen law. A consumer may bring or defend proceedings in any court that has jurisdiction under applicable consumer-jurisdiction rules. Nothing in these Terms requires a consumer to litigate exclusively in Sofia, Bulgaria.
If you are acting in the course of a trade or business and mandatory law does not provide otherwise, the courts in Sofia, Bulgaria have exclusive jurisdiction over disputes arising from or connected with these Terms.
22. Changes to these Terms
We may update these Terms for valid reasons, including changes to Night Eye, law, security requirements, payment or browser-store rules, or to improve clarity.
Updated Terms apply immediately to new users who accept them. For existing users, we will give reasonable advance notice of material changes by email, an in-extension notice or another durable method where required. Material changes will not retroactively remove rights already accrued or reduce mandatory rights. A price change to an annual subscription is handled under Section 9.3.
Where required by law or because a change materially alters the contract, we will request renewed acceptance. If a material change adversely affects continuously supplied paid functionality, we will provide any cancellation, termination or reimbursement right required by applicable law. Continued use alone will not be treated as consent where affirmative consent is legally required.
23. General provisions
23.1 Entire agreement
These Terms, the information shown at the relevant checkout, the order confirmation and any specific plan terms presented before purchase form the agreement concerning Night Eye. The Privacy and Cookie Policy explains data processing but does not replace these contractual Terms.
23.2 Order of precedence
For billing administered by Apple, mandatory Apple transaction rules apply to the relevant payment-administration issue. Otherwise, a specific checkout or order-confirmation term controls over a conflicting general product description, and these Terms control over non-binding informational material. Mandatory law always prevails.
23.3 Severability
If a provision is invalid or unenforceable, it will be applied only to the extent lawfully possible and the remaining provisions will continue in effect. For consumer contracts, an unfair or invalid term will not be rewritten in a way that deprives the consumer of protection provided by law.
23.4 No waiver
A failure or delay in enforcing a right does not waive it.
23.5 Assignment
You may not transfer a paid licence or these Terms without our written consent, except where mandatory law permits it. We may transfer our rights and obligations as part of a merger, reorganisation, sale of business or similar transaction, provided that the transfer does not reduce mandatory consumer rights. We will provide notice where required by law.
23.6 Electronic communications
Contractual notices and confirmations may be sent electronically to the email address connected to your account or displayed in a form capable of being retained where required by law. You are responsible for keeping your email address current. This does not limit any legal requirement concerning the form or delivery of a notice.
